Ontario Bar Association publishes best practices for remote hearings
Updated: May 23, 2020
South Africa appears to be lagging other common law jurisdictions when it comes to the publishing of Remote Court Protocols.
The 'best practices' give guidance to counsel and parties for the proper conduct of a remote Court, and stress that the best practices are subject to continued evolvement, and subject of course to the discretion of the judge hearing the matter.
“These Best Practices will be reviewed periodically to take into account developments related to remote hearings, including evolving knowledge, experience and best practices stemming from the increased use of remote hearings during the COVID-19 pandemic and beyond.”
What is particularly helpful is the three checklists drafted by the Ontario bar association, namely a checklist for preparing your system for a remote hearing, counsel preparation in advance of meeting with the adjudicator, and matters to consider reviewing with judge in advance of the hearing. The checklists are available to download in word format from the following website: https://www.oba.org/2020_COVID_19/News-Updates/Up-to-date-Justice-Sector-Information/News-update/Best-Practices-for-Remote-Hearings
